Wisconsin Family Plans to Sue Day Care After Baby Tested Positive for Cocaine

A Wisconsin family is preparing to sue one of the largest childcare companies in the country after their one-year-old child tested positive for cocaine while under the care of a KinderCare Learning Center in Oak Creek, WI.

Attorney B’Ivory LaMarr, representing Kimberly Hopson, the mother of the child, told TMZ that the family plans to file a lawsuit against KinderCare for alleged child neglect.

According to Hopson, her son became extremely ill while at the daycare earlier this month. When she picked him up, he had multiple bruises and abrasions, including one in his mouth. Hopson took her son to the hospital, where tests revealed that the child had cocaine in his system. Oak Creek Police confirmed these findings in a press release, stating that cocaine was discovered in a staff member’s bag during a search of the facility.

The staffer in question was arrested on drug charges and a child neglect charge, although the neglect charge was later dropped, leaving two counts of drug possession.

LaMarr stated that KinderCare has apologized and offered to cover some medical expenses, but the family believes this is insufficient. They plan to sue for negligence, negligent supervision, premises liability, assault, and battery, among other potential claims.

The Hopson family will hold a press conference on Wednesday to address the situation further. Attempts to reach KinderCare for comment have so far been unsuccessful.
